These Terms and Conditions (“Terms”) apply to:

  • The OPSEN platform (including the web and mobile applications).

 

By accessing or using our website, applications, or services, you agree to be bound by these Terms.

  • Optional GPS tracking integration

OPSEN is offered on a monthly or yearly subscription basis.

Subscriptions are arranged directly with TJ Software Solutions and managed via invoicing, not through online purchase.

 

4. User Accounts

To use certain OPSEN features, users may need to create accounts.

You agree to:

  • Provide accurate and up-to-date information.

  • Keep your login details secure and confidential.

  • Accept responsibility for all actions taken through your account.

  • We reserve the right to suspend or terminate accounts that violate these Terms or misuse our services.

 

5. Payment and Billing

 

  • OPSEN operates as a subscription-based service.

  • Plans are billed monthly or annually, in South African Rand (ZAR).

  • Optional modules or GPS add-ons may incur additional fees.

  • Late or missed payments may result in suspension of access until settled.

  • All payments are non-refundable unless otherwise agreed in writing.

  • Custom development projects are billed separately under individual agreements.

 

6. Intellectual Property

All intellectual property, including the OPSEN platform, design, source code, brand, and content, is the exclusive property of TJ Software Solutions (Pty) Ltd.

You may not copy, modify, reproduce, or distribute any materials without written consent.

OPSEN and its associated branding are protected by South African intellectual property law.

 

7. Data Protection and POPIA Compliance

TJ Software Solutions complies with the Protection of Personal Information Act, 4 of 2013 (POPIA).

By using our website or OPSEN, you consent to the lawful collection and processing of your personal information for legitimate business purposes, including:

OPSEN may integrate with third-party platforms, including Google Maps, Apple Maps, or similar services.

When using these integrations, users are subject to the terms and privacy policies of the respective providers.

 

TJ Software Solutions is not responsible for the data handling or availability of third-party systems.

 

11. Termination

 

We may suspend or terminate your access to OPSEN if you:

  • Breach these Terms or misuse the platform.

  • Fail to make payment.

  • Engage in activity that could harm the system or other users.

Upon termination, user data may be retained for a limited period for legal or accounting purposes before being securely deleted in accordance with POPIA.

 

12. Limitation of Liability

 

To the fullest extent permitted by law, TJ Software Solutions (Pty) Ltd will not be liable for any direct, indirect, incidental, or consequential damages arising from:

  • The use or inability to use OPSEN or our website.

  • Data loss, downtime, or third-party service issues.

  • Errors or inaccuracies in platform data.

  • All use of our Services is at your own risk.
